Do not put words in my mouth, I do not fail to understand anything. He should be criminally negligent and the uniform has a lot to do with that. As you point out families lawyers are not done civilly with this jacka$$, what sucks is the officer will never be the one to pay. His only repercussions at this point would seem to be a few days off and some embarrassment (if he is intelligent enough to realize it). His suspension is actually an admission that he did something wrong, I am sure the families lawyers have already pointed that out.

Make it apples to apples:
Similar set of case facts- purportedly intoxicated individual, non-government boat, improperly applied life jacket, speeds under posted limit, limited experience on behalf of the sober operator, one or two cruiser wakes, MOB resulting in death.
Criminal negligence? Probably not. Maybe, but probably not. Civil negligence? Absolutely.

The officer broke policy at the speed he was going, is that criminally negligent? I dont know. Although proving he was careless/reckless wouldnt be that much of a stretch. If I read correctly the officer lied under oath, now that is criminal.
His supervision trying to cover up the situation is even worse than the his actions/inaction. And the radio talk about his son not going to get any more dead is unprofessional as it gets.

The officer will never be the one to pay?! Maybe not financially, but unless he's a sociopath, he's paying, and dearly. If you think anyone other than a sociopath wakes up the day after something like this and goes about business as usual, you have even less faith in humanity than I, sir.
