normally in business law, you aren't able to sell a company that is involved in a lawsuit, so you may want to have your attorney check into the legality of the sale. you arent allowed to sell assets that may be held in forfeit pending a lawsuit. if it were that easy every business would be sold at the slightest hint of hardship.

So how do so many (more than one is a lot in this case) get screwed by a company yet bondo10 got that supersonic 42 on time , perfect, no issues, loves it so much he had them build him a cc? I'm not questioning the claims, but trying to figure out how you put trust in a company like this, and how they can deliver the worst and best ?

I would think the 10 year warranty is out the window......unless the new owners want to be really good guys about it.

Individuals will certainly help, as long as they have assets.

If you plan on absconding with the money from the sale you would be 100% correct. But in this case all he would have to say is he sold the assets so he could pay the lawyers to defend this case and the sale point would be moot. I don't believe he would have sold the company, but rather just the molds. Look at what Pantera was able to do for years to multiple creditors......lawsuits with judgments in hand were unable to get paid.

Also the dollars involved in the sale can't be significant amounts.....company was basically at a standstill, zero good will and name wasn't exactly a household name.
