Can you go to the actual opinion and find that language or anything that seems to say that? I couldn't, but I will admit to reading it VERY quickly. Also, a non retroactive application would seem to be at odds with finding Sec. 3553 unconstitutional. I think (on my cursory reading) the opinion seems to imply that retroactivity will be required.
