Drive leak - Can this be the cause?

I received the drive crated up and on its side. It remained on its side in the crate for a couple of weeks.
After uncrating it and storing upright over the winter I noticed gear lube coming from the joint between the upper and lower. Evidently the drive was shipped full of gear lube.
As this was a rebuilt drive, is there a chance that the lube came out of a vent or something and then when i stood it upright it leaked out?
Why else would the drive be leaking here? Its never been on a boat since the rebuild.
